Terms of Service

Welcome to ShoKomu. These Terms of Service ("Terms") govern your access to and use of the ShoKomu web application and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using ShoKomu in any way, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person or entity, you represent that you have the authority to bind them to these Terms.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.

2. User Accounts

ShoKomu uses Google OAuth to authenticate users. By signing in with Google, you authorize ShoKomu to receive your name and email address from Google to create and maintain your account. You are responsible for keeping your account access secure.

You agree to provide accurate information when prompted, and not to impersonate any person or misrepresent your identity. You may not create accounts for automated use or for any purpose other than genuine personal use of the Service.

We reserve the right to suspend or terminate your account at our discretion, particularly if we believe you have violated these Terms or are using the Service in a way that may harm other users or the integrity of the platform.

3. Acceptable Use

You agree to use ShoKomu only for its intended purpose: tracking and organizing shared expenses among groups of people you know. You may not use the Service to:

  • Harass, threaten, or harm other users
  • Submit false, misleading, or fraudulent expense data
  • Attempt to gain unauthorized access to other users' accounts or data
  • Scrape, reverse-engineer, or copy any part of the Service
  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Interfere with or disrupt the integrity or performance of the Service

We reserve the right to investigate and take action against any use we believe violates these Terms, including removing content and terminating accounts.

4. Expense Data

When you create groups and log expenses on ShoKomu, that data belongs to you and the members of your groups. You grant ShoKomu a limited license to store, process, and display this data solely as necessary to provide the Service to you and your group members.

You are solely responsible for the accuracy of the expense data you enter. ShoKomu does not verify the accuracy of any expense amounts, descriptions, or participant lists. Disputes between group members regarding expenses are your responsibility to resolve.

Group creators and administrators have the ability to modify group settings and manage members. All group members can view the expense history for groups they belong to.

5. Payments and Settlements

ShoKomu is an informational tool for tracking and calculating who owes what within a group. ShoKomu does not process any real financial transactions, hold funds, or facilitate actual money transfers.

When users "settle up" within ShoKomu, this refers to recording that a payment has occurred outside the app — for example, via bank transfer, cash, or a third-party payment service. ShoKomu simply records this as a settlement to update the balance display.

ShoKomu bears no responsibility for any actual monetary transactions that take place between users. All real money transfers are the sole responsibility of the parties involved.

6. Intellectual Property

All content, design, code, and materials comprising the ShoKomu Service — excluding user-generated expense data — are the property of the ShoKomu developer and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

You retain ownership of the expense data and content you submit to ShoKomu. By submitting content, you grant us the rights necessary to provide the Service as described above.

7. Availability and Changes

ShoKomu is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

We may add, change, or remove features at any time. Where possible, we will provide advance notice of significant changes that may affect your use of the Service.

8. Termination

You may stop using the Service at any time. You may also request deletion of your account and associated data by contacting us at maxim.synyava@gmail.com.

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination will remain in effect.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ShoKomu and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or financial disputes arising from your use of the Service.

In no event shall our total liability to you exceed the amount you have paid us in the twelve months preceding the claim, or €50, whichever is greater. Because ShoKomu is currently free to use, this limit is €50 in most cases.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Disclaimer of Warranties

The Service is provided without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved amicably, the parties agree to submit to binding arbitration or the courts of the applicable jurisdiction.
